Zoning Board Approves Digital Billboard Conversion on Dunstable Road

Tyngsborough's Zoning Board of Appeals unanimously approved converting a Dunstable Road billboard from print to digital, then spent most of Thursday's meeting on a new state variance standard. Town Counsel Adam Costa told the board that Massachusetts recently scrapped its 45-year-old three-part variance test in favor of a "practical difficulty" standard requiring the board to weigh benefits to applicants against neighborhood detriment, calling it "a little bit of a different test than you're used to applying." The board also continued two other hearings to October 8: a setback variance for a 26-by-20-foot addition at 136 Lakeview Ave. sought by Fabienne B. Myrthil, and WL Development's frontage and height variance for a senior living community at 84 Kendall Rd., which a project representative said is dropping its 40 age-restricted cottages in favor of an expanded 150-foot buffer.
Costa said Tyngsborough's own bylaw is already partly out of compliance with the amended statute and will need revision.
