Planning Board approves Toll Brothers stormwater basin redesign
Planning Board · Meeting of September 3, 2026
Tyngsborough Planning Board clears Toll Brothers basin fix, holds two other projects. The board voted unanimously to let Toll Brothers convert five failing stormwater basins at its Enclave development into "extended dry detention" basins after testing showed the soil couldn't support the original infiltration design. Land Development Director Ted Merchant said the work would take about two weeks to build and two more to test, weather permitting.
Resident John McInerney, of 33 Juniper Lane, pressed the company on "plan B" and possible HOA fee increases if the fix fails; board members said maintenance costs are a matter between Toll Brothers and the homeowners association. The board also continued Connell Construction's 25 Ingalls Road subdivision, Otis Woods, to September 17 pending conservation review, and continued WL Development's 84 Kendall Road senior living proposal to October 15, with Vice Chair Jeremy Baldwin abstaining.
