Tyngsborough Conservation Commission Continues Four Hearings, Issues One Certificate of Compliance

Tyngsborough Conservation Commission continued all four active permit hearings to August 11 at its July 28 meeting, with the Otis Woods subdivision and a Merrimack riverfront house project generating the most contested exchanges. At 25 Ingalls Road, abutter Jason McGurkey of 23 Ingalls Road told the commission that a site profile graphic submitted by the applicant's engineer was "drastically misleading," arguing the grade from the proposed infiltration basin to his property line exceeds the 15-percent threshold that triggers a 50-foot stormwater setback, and that his attached garage — mislabeled as a shed on project plans — should trigger a 100-foot foundation setback, potentially requiring the basin to be relocated. For the 137 Pawtucket Boulevard riverfront project, consultant Gunn Lease of Land Engineering and Environmental Services acknowledged that the project narrative incorrectly stated the project "does not propose to alter or fill" bordering land subject to flooding, agreeing to revise the language and provide a more detailed alternatives analysis before the next hearing.

A Certificate of Compliance was issued for 166 Sherbin Avenue (DEP 309-1015) on a unanimous vote.
