Tyngsborough Planning Board Seeks Legal Options Over Enclave Developer's Stalled Drainage Work

TYNGSBOROUGH — September 19, 2024 — Tyngsborough Planning Board escalates pressure on Enclave subdivision developer over stalled stormwater repairs. Town Planner and Economic Development Director Ben McClure — attending his first meeting in the role — reported September 19 that a same-day field inspection found five or six of the project's eight drainage basins still holding water despite an extended dry period, well past the required 72-hour infiltration standard, with no grouting work completed. Member Dave Robson demanded to know why the board had tolerated the delays, asking "what are we doing?" while member Chaz Dowdy said the developer's feet needed to be "put to the fire." The board directed McClure to follow up with Town Counsel on what enforcement authority the Planning Board holds — independent of the building inspector and alongside the Conservation Commission, which issued its own concurrent response — and asked that Counsel attend the October 3 meeting with a formal legal opinion.
