Tyngsborough Planning Board Grants Warehouse Project One-Year Permit Extension

TYNGSBOROUGH — September 5, 2024 — Tyngsborough Planning Board approved a one-year special permit extension for a large warehouse development at 406-424 Middlesex Road and unanimously approved a residential in-law addition on Jakes Road at its September 5 meeting. The Middlesex Road project, originally permitted September 14, 2022, had stalled amid what the applicant's attorney described as "the downturn in the capital markets and the interest rates and the inflation situation," and will now expire in September 2025 rather than the two years requested; the vote was 4-1, with member Chaz Dowdy dissenting over a height variance the applicant had obtained from the Zoning Board of Appeals after the board's stated opposition. The board also voted unanimously to continue an approval-not-required plan for 198 and 200 Sherbin Avenue to its September 19 meeting, pending clarification from the town's reviewing engineer about foundation language in his report. On Jakes Road, Tim and Jennifer Wilson received unanimous approval for a 28-by-28-foot temporary independent living quarters addition totaling 1,194 square feet, sitting nearly 49 feet from the nearest lot line against a 30-foot requirement. Members closed the meeting with a directive to consult Town Counsel about enforcement options at an unnamed Frost Road property where a permitted applicant completed stormwater work but declined to finish a required parking lot.
